Duty of Care

The ‘Health & Safety at Work Act of 1974” was Established to make provision for securing the health, safety and welfare of persons at work.

As an Artist, Production or Tour Manager you will be requiring the temporary services of many skilled people for your Tour or Event. Just as a full time employer, you engage their services, thus making you responsible for their Health & Safety at Work.

You have a ‘Duty of Care’ for those employees and are legally bound. Your failure in any form that leads to Injury of said temporary employees could see you entwined in a potentially long and in many cases expensive legal battle that could potentially end in bankruptcy or in the worse case prison.

However, you may not know but you also have a ‘Duty of Care’ and protection for others against risks to their health or safety in connection with the activities of persons at work.

‘Others’ meaning: Attendees of your event.
‘Persons’ meaning: Your temporary employees.

Don’t just take our word for it.

Examples

In 2003, at the Station Night Club in Rhode Island during a performance of the rock band ‘Great White Hope’ a fire broke out due to the bands Pyro Techniques. It leads to the death of 100 attendees and workers, and also accounted for the injuries to 230 more people.

On December 9, 2003, brothers Jeffrey A. and Michael A. Derderian, the two owners of The Station nightclub, and Daniel M. Biechele, Great White's former road manager, were charged with 200 counts of involuntary manslaughter — two per death, because they were indicted under two separate theories of the crime: criminal-negligence manslaughter (resulting from a legal act in which the accused ignores the risks to others and someone is killed) and misdemeanor manslaughter (resulting from a petty crime that causes a death). The three men pleaded not guilty to the charges. The Derderians also were fined $1.07 million for failing to carry workers' compensation insurance for their employees, four of whom died in the blaze.

Paul Carroll holds the NEBOSH General Certificate that is based entirely on Health and Safety legislation, both in a legal, civil and moral sense - effectively the duties that are bestowed on any Employer or Organization relating to the protection and safety of Employees, Sub Contractors and any member of the Public that may be affected by what they do as a business.

Paul’s NEBOSH qualification entitles him to membership of IOSH, The Institution of Occupational Safety and Health, which is the world’s leading professional body for people responsible for health and safety in the workplace. Paul holds Technical membership status. Paul Carroll not only holds this NEBOSH certificate, but also excelled and gained ‘Distinction’ in this field. The last section of this modular qualification looks deeply into the application of Health and Safety across all sectors of Industry - The needs for policies, risk assessments and safe working practice, how that is communicated throughout an organization and how the company involved can best mitigate against the risks that are presented when it comes to Health and Safety.

Paul’s extensive background in the live events industry means, not only can he offer the required technical knowledge in his field, but is also able to demonstrate the highest levels of competence in our industry. 15 year’s experience as Operations Manager for a leading events security company, running large scale events from 15000 capacity arenas through to Stadium sized shows enabled Paul to develop the necessary skills to excel in his field. A successful touring career with HSM followed, where Paul took on the role of Security Director for artists such as Rammstein, Pink, Kings of Leon and Kaiser Chiefs.

Essentially, in terms of application to an event, Paul can identify where the duties of the Organizer, Production or Tour Manager or Promoter would sit in terms or their legal responsibilities, help to establish best working practices, provide risk assessments and method statements to mitigate the risks associated with all aspects of the event. Paul would also be able to oversee working practice from start to finish to ensure risks to the client are controlled throughout.

Additionally, Paul can apply relevant legislation in terms of fire safety, electrical safety, noise and environmental risks etc. - all of which have potential risks to the you, the client, as well as adding further support in licensing issues, applications etc. should this ever be required.

A further service Paul and HSM can provide could be in collaboration with other stakeholders at an event in establishing Emergency Liaison Teams, providing written process documents to enable safe emergency procedures in collaboration with HSM qualified Crowd Managers and looking specifically at how these procedures would sit legally in the event of an accident or injury occurring at an event.

Currently Paul Carroll is working on his Diploma which will be completed by end of July this year. It is run by an organization called the ‘National Compliance and Risk Qualifications’ - its a Level 6 Diploma in Applied Health and Safety. This qualification looks more specifically at the application of Health and Safety legislation in any given environment - essentially being able to identify and address risks in any situation and mitigate against them.

Once completed, Paul would qualify for the Chartered Membership program with IOSH - something that is again globally recognized. The UK, as you know, are widely thought of as the global leaders in Health and Safety best practice. Chartered Membership is a 2-year process - from a qualifications perspective, the highest entry level to IOSH is Graduate Level, which Paul will be awarded once the Diploma is complete.

Paul has also obtained membership to the IIRSM - The International Institute of Risk and Safety Management, a global organization for Safety Professionals which is also recognized at the forefront of Health and Safety globally.

Consider the financial implications of your failure to provide a ‘Duty of Care’ to your Workers and Attendees, but also consider the ‘Moral Stance ‘in the same importance.

In 1991 Grunge hit the UK and with it came a whole new issue of safety at concerts: Surfing. This craze seemed to be misunderstood by, at that time, Bouncers acting as Concert Security. There was a cry from bands for the need of a new style of security, one that understood the music, the genre and most importantly the fans.

And so the story begins

Two years later – Colin Lish and Steve Head joined a concert security company and with their knowledge and love of music, accepted the challenge and set out on a quest to find music-loving security staff… and so the story begins.

In 1993, Brit Pop exploded: Oasis, Pulp, Blur and the Verve took the UK music scene by storm and a whole new type of fan was born. Aggressive, boisterous and led by a bond of camaraderie with their fellow fans produced a very different issue at concerts: mass crowd movement.

This produced the need for bands to have a voice regarding the safety of their fans and that’s where Colin and Steve found a niche.

So, from 1993 to 2000, they worked tirelessly to find Security Staff that understood the music, the genre, what issues came with each artist and a solution to give the band a voice and say in the safety of their fans.

In 2000 Headline Security Management Ltd (HSM Ltd) was born and here we are in 2023 with a current client list that looks like a historical view of BRIT and Grammy winners.

We stringently look at the client, its genre, its history and then select the member or members of staff that are best suited. This has always been our way and that’s the key to our 16 year’s success.

Practical experience and academic theory

In 2012 Colin, Steve and David White (the company's Crowd Management Consultant), agreed that to give advice on behalf of touring artists in regards to safety of their fans, should not only be based on practical experience but underpinned by the science of Crowd Dynamics, the understanding of Crowd Behaviour and Crowd Safety by design, and all took on the prestigious ‘Crowd Safety Management Degree at Bucks New University, the international centre for Security Studies.

All gained their Bachelor of Science Degrees in this specialist field.
